1. Agreement to Terms

By accessing or using the website and services provided by Glafix Web Services ("Glafix," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Products and Platform

Glafix operates a managed website platform offering digital products and subscription services for small businesses. Our products include:

Industry-specific website templates (digital product, one-time purchase)
Managed hosting subscriptions with SSL, backups, and monitoring
Content management subscriptions for ongoing updates and SEO optimization
AI chatbot add-on subscription

Customers discover Glafix through Google search, social media, and direct referrals, and purchase templates or subscribe to monthly hosting plans directly through our website.

3. Free Preview

We offer a free preview of your customized website template within 24 hours of receiving your request. The preview is provided at no cost and with no obligation. You are not required to purchase the template or subscribe to a plan after reviewing your preview. Preview websites are temporary and may be removed after 30 days if you choose not to proceed.

4. Pricing and Payment

Template Purchase: A one-time fee of $85 USD for your industry-specific website template, charged after you approve your preview and decide to launch.
All-Inclusive Monthly: $59 USD per month for managed hosting, SSL, daily backups, uptime monitoring, content updates, SEO optimization, AI chatbot, and priority support. Everything included.

All prices are in US Dollars. We charge one-time fees for digital template purchases and recurring monthly subscriptions for hosting and content management delivered through our platform. We reserve the right to adjust pricing with 30 days written notice to existing subscribers. Price changes will not apply retroactively.

5. Website Ownership

You own 100% of your website content, including text, images you provide, and your brand assets. The customized website template becomes your property once the template purchase fee is paid. If you choose to leave Glafix, we will assist you in migrating your website to another provider at no additional charge.

6. Client Responsibilities

As a client, you agree to:

Provide accurate and complete information about your business
Supply any content (text, images, logos) needed for your website in a timely manner
Ensure that all content you provide does not infringe on any third-party rights
Make payments on time as per the agreed billing schedule
Not use the website for any illegal, harmful, or fraudulent activities

7. Cancellation

There are no long-term contracts. You may cancel your subscription at any time with 30 days written notice. Upon cancellation:

Your website will remain live until the end of your current billing period
You may switch to the $9/month Hosting Only plan to keep your site live without support or updates
We will provide a complete backup of your website files upon request
We will assist with migration to another hosting provider if needed, at no extra charge
You may also host your website yourself for free using platforms like Vercel
The one-time template purchase fee is non-refundable

8. Content Management

Your $59/month all-inclusive subscription includes up to 2 hours of content management per month. This includes text changes, image swaps, adding new sections, and minor design adjustments. Unused hours do not roll over. Requests exceeding the monthly limit may incur additional charges, which will be communicated in advance.

9. Uptime and Availability

We strive to maintain 99.9% uptime for all hosted websites. However, we do not guarantee uninterrupted service. Scheduled maintenance, server issues, or circumstances beyond our control may occasionally affect availability. We are not liable for any losses resulting from temporary downtime.

10. Intellectual Property

The Glafix name, logo, and branding are the property of Glafix Web Services. Third-party images used on your website (such as stock photos) are subject to their respective licensing terms. We ensure that all images used are properly licensed for commercial use.

11. Limitation of Liability

To the maximum extent permitted by law, Glafix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from or related to the use of our services. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Glafix, its team members, and affiliates from any claims, damages, or expenses arising from your use of our services, your website content, or your violation of these terms.

13. Modifications to Terms

We reserve the right to update these Terms of Service at any time. We will notify active clients of significant changes via email. Continued use of our services after changes are posted constitutes acceptance of the updated terms.

14. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation before pursuing any legal action.
